These Terms of Service ("Terms") apply to your use of clarech.com and any purchase from Clarech ("we," "us," "our"). By using our site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you give us is accurate and that you're authorized to use your payment method.

2. Products and descriptions

We try to describe and photograph our products accurately. Colors may look slightly different depending on your screen, and sizes and measurements are approximate. Product names such as "Ice Silk" describe a product's feel or finish and don't necessarily describe what the material is made of. Please check product details and measurements before ordering.

3. Not medical advice

Our products are designed for comfort and are not medical devices. They are not meant to diagnose, treat, cure, or prevent any condition, including sleep disorders. If you have ongoing trouble sleeping, please talk to a healthcare professional.

4. Product safety

Please follow all instructions and warnings that come with your product. For electric and heated products in particular:

Don't use a heated blanket on infants, young children, or anyone who can't operate the controls or is unable to feel heat.
Don't fold, bunch, or tuck the blanket while it's on, and don't use it if the cord, controller, or blanket is damaged.
Turn it off and unplug it when not in use.

We're not responsible for injury or damage caused by misuse or by not following product instructions.

5. Pricing and availability

All prices are in US dollars. Prices, promotions, and product availability can change without notice. If an item is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after it's confirmed.

6. Orders and payment

Placing an order is an offer to buy. We may accept, limit, or cancel any order, including for suspected fraud, and we'll refund any payment for a canceled order. Payment is processed securely at checkout, and we don't store your full card details. Discount codes can't be combined unless we say otherwise, and they have no cash value.

7. Shipping

Delivery times are estimates, not guarantees. Items in a kit may arrive in separate packages. Risk of loss passes to you once the carrier marks your order as delivered. See our Shipping Policy for details.

8. Returns and refunds

Returns and refunds are handled according to our Returns & Refunds policy.

9. Reviews and content you submit

If you post a review, photo, or other content, you give us a non-exclusive, royalty-free right to use, display, and share it in connection with our store and marketing. You're responsible for making sure your content is honest, is your own, and doesn't break any laws. We may remove any content at our discretion.

10. Intellectual property

All content on this site, including text, images, logos, and design, belongs to Clarech or its licensors and may not be copied or used without our written permission.

11. Prohibited use

You agree not to use the site for any unlawful purpose, place fraudulent orders, interfere with the site's security or operation, or collect other users' information.

12. Third-party links and services

Our site may link to or use third-party services, such as payment processors, shipping carriers, and review apps. We're not responsible for their content, policies, or practices.

13. Disclaimer

Except as stated in these Terms or required by law, the site and products are provided "as is" and "as available," without warranties of any kind, whether express or implied.

14. Limitation of liability

To the fullest extent permitted by law, Clarech will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the product involved.

15. Indemnification

You agree to defend, indemnify, and hold harmless Clarech from any claims, losses, or expenses (including reasonable legal fees) that arise from your misuse of the site or products, or your breach of these Terms.

16. Governing law

These Terms are governed by the laws of the State of Florida and applicable US federal law. Any disputes will be handled in the courts located in Broward County, Florida.

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continuing to use the site after changes means you accept them.
